Child Support Modification and Enforcement

Child Support Attorney Serving Denton, Lewisville, and Flower Mound

Like conservatorship (child custody) and visitation rights, Texas child support obligations are imposed by order of the court. As a result, if you need to seek modification or enforcement of Texas child support obligations, you should hire an attorney to take you through the formal legal process.

At Helene Parker & Associates, L.L.C., Ms. Parker is an experienced and compassionate Lewisville child support attorney. Our staff prides ourselves on keeping our clients informed, explaining their options, and providing thorough representation of their interests in court.

Modification of Texas Child Support Orders

Texas child support orders can be modified under the following conditions:

  • Circumstances (typically, the employment status of the parent paying child support) have changed substantially since issuance of the child support order; or
  • “[I]t has been three years since the order was rendered or last modified and the monthly amount of the child support award under the order differs by either 20 percent or $100 from the amount that would be awarded in accordance with the child support guidelines” under the current circumstances. Tex. Stat. Family Code Sec. 154.401.

It’s important to note that an informal agreement between the child’s parents is inadequate to modify either parent’s child support obligations. Child support obligations are imposed by order of the court, and failure to adhere to a court order can result in a finding of contempt. Also, just because you and your former spouse or partner are able to agree on a modification now, there is no guarantee that the modification will remain acceptable in the future. If a dispute arises, not only will you be held in contempt, you will also face possible jail time, and you will be liable for any amounts not paid, plus interest plus attorney’s fees and costs.

As a result, if you need to seek modification of a Texas child support order, you should hire an experienced Lewisville child support lawyer who can present your case to the appropriate court to obtain a binding legal modification.

Lewisville Child Support Attorney for Child Support Enforcement

If your former spouse or companion is not meeting his or her child support obligations, the proper course of action is to seek enforcement by the appropriate Texas court. You should not deny visitation or interfere with his or her rights of joint conservatorship (child custody). In Texas, child support, visitation, and custody rights are all independent of one another, so your denial of visitation or possession will be a court order violation even if you have not received the child support to which you are entitled.

Enforcement mechanisms and other remedies you can seek in connection with a failure to pay child support in Texas include:

  • Garnishment of wages
  • Incarceration
  • License suspension
  • Probation
  • Modification of custody and visitation rights such as termination of parental rights

The Lewisville child support lawyer at Helene Parker & Associates, L.L.C. has over 16 years of experience helping custodial parents enforce child support obligations and seek modification of custody and visitation rights in connection with child support deficiencies.
